Event Focus

The dual impact of the European Convention on Human Rights (and European jurisprudence on Convention rights) and multi-jurisdictional families can result in serious difficulties for executors and trustees in identifying their beneficiaries.  

Speakers will cover:

  • the impact of ECHR/Human Rights Act 1998 on trusts and wills following the English decisions of Re Erskine and Re Hand's Will Trust;
  • private international law concerning personal status; and
  • discuss the impact of the same when construing wills and settlements, particularly in relation to the meaning of "children", "issue" and "descendants".
